A South Dakota marijuana legalization petition has been approved by Attorney General Marty Jackley. On May 17, 2017, Jackley issued an Attorney General Explanation for the legalization initiative that aims to legalize all quantities of marijuana and have the South Dakota Department of Agriculture establish a regulatory system for recreational marijuana.

PIERRE, S.D., May 17, 2017 /Weed Wire/ — South Dakota Attorney General Marty Jackley announced today an Attorney General Explanation for a proposed initiated measure has been filed with the Secretary of State.
On Aug. 15, 2016, two consultants hired by the Flandreau Santee Sioux Tribe to open a marijuana resort in South Dakota entered opposing pleas to drug charges at the Moody County Courthouse.
On Saturday, Nov. 7, the Flandreau Santee Sioux Tribe burned its first marijuana crop, reportedly worth millions of dollars, and stopped development of a first-ever marijuana resort to be constructed on the reservation.
This past June, the Flandreau Santee Sioux legalized the possession, consumption, cultivation and distribution of marijuana. This is in preparation for the tribe’s yearlong project of building the first-ever marijuana resort on a reservation.
