A man from western Massachusetts has been posting ads on Craigslist offering free marijuana with the purchase of an empty sandwich bag, according to New England Public Radio.
Selling marijuana isn’t yet legal in Massachusetts, but individuals are allowed by law to give away up to an ounce of it.
“I am selling you an empty bag. Marijuana placed In that empty sandwich bag is simply a legal gift,” read one of the ads.
How much “free” marijuana one gets varies with how much one spends. Purchasing a $20 bag would give someone a gram of marijuana, while a purchase of $325 would give someone 27.8 grams, .2 grams shy of the 28-gram limit.
While the ads use clever reasoning in an attempt to circumvent the law, the ads are still illegal. Under Massachusetts law it is legal to give away up to an ounce of marijuana, but only “as long as the transfer is not advertised or promoted to the public.”
Speaking with New England Public Radio, Northwestern District Attorney David Sullivan said that he would ask law enforcement to investigate the ads. “I think it’s a clear fraud on its face,” Sullivan stated.
According to NBC Boston, the ad has been “flagged for review” by the Craigslist website. “If that person were to be located, he or she could be prosecuted or charged,” added Chelsea Police officer Will Brizuela.
