Health Canada Granting Patients Right to Grow Medical Cannabis at Home

On Aug. 11, 2016, Health Canada announced that it had replaced the Marihuana for Medical Purposes Regulations with the Access to Cannabis for Medical Purposes Regulations, as prompted by the Federal Court of Canada’s decision in Allard v. Canada.

Starting on Aug. 24, the ACMPR will allow medical cannabis patients, authorized by health care practitioners and registered with Health Canada, to cultivate a limited amount of medical cannabis at home, designate caregivers to cultivate it for them or purchase it from one of Health Canada’s 34 licensed producers.

The “limited amount” of medical cannabis that each patient will be allowed to grow will be determined by a formula that accounts for the patient’s daily dose and the average yield per plant under specific cultivation conditions.

Health Canada will provide additional information on its website beginning on Aug. 24.
